How Trump, Cruz and Rubio could UNITE the GOP

This is such an interesting idea that I had to get it out to the blog.

The Republicans must unite to defeat Secretary Hillary Clinton and unless they want to do something bold at an open convention like nominate former Secretary of State Condoleezza Rice, they better find a way to unite.  But there has been tremendous rancor between Trump, Cruz and Rubio.

Here’s my two cents:  Trump offers the VP spot to Cruz at a three way meeting with Rubio in attendance.  (It might be difficult to get all three together secretly but it can be done.)  BUT, the kicker is that Cruz will ultimately be nominated after the inauguration to the vacant Supreme Court spot formerly held by Justice Scalia and then the Congress will be asked pursuant to the 25th Amendment to elect Rubio to the VP spot.  The Establishment gets Rubio as VP so provided the GOP wins and keeps both houses of Congress, Rubio is in and would be up in 4/8 years to run in his own right.  They also get rid of Cruz for good:  He’s on the SCOTUS.

The Trump Cruz ticket forms immediately; Rubio endorses it and then the new slogan of the unity ticket is:

Make America Great Again for a New American Century

The way each candidate walks back their prior comments is to push party unity and that our differences are tiny compared to the radical agenda Hillary has.

Are you purposely opening up the “eligibility” question or do you really believe that
both Cruz and Rubio meet the Constitution’s natural born citizen requirement?

Rubio was groomed by big money for the presidency. The Gang of 8 was a disaster which would have ruined the party and the whole country. What has he ever accomplished? He’s articulate and young and a first term senator. Who does that remind you of?

I am sure you realize that not all native born citizens of the U.S. qualify as natural born citizens of the U.S. Most historical research on “The Laws of Nature and Natures God” conclude that a child inherits, at birth, the membership in the community of their birth parents. In Senator Rubio’s case that would be membership in the Cuban community, since his parents were Cuban citizens at the time of his birth in the U.S. U.S. naturalization law (man made law) naturalized Senator Rubio as a U.S. citizen at the time of his birth in the U.S.

Natural born citizens do not require any action by a governmental authority to become a U.S. citizen.

Senator Cruz has a similar problem since he was born in Canada to a naturalized Canadian citizen father and mother; both parents were registered to vote in Canada and his parents became Canadian citizens in 1970. At the time of Senator Cruz’s birth Canadian law did not permit dual citizenship. And, I am sure you know that Senator Cruz has sealed any and all his U.S. related citizenship records and those of his mother; just like BHO did. Sure makes one wonder what he is hiding?

    • The Fourteenth Amendment still says all persons born or naturalized in the United States are citizens of the United States and that makes Rubio eligible and probably Cruz too. I also refuse to adopt a constitutional theory that disenfranchises all of the great military “brats” born abroad of US parents (one or both are serving their nation) from the highest office in the land.

Now Rubio might be seen in Cuba as a Cuban citizen or Cruz might be seen in Canada as a citizen but that does not render them constitutionally ineligible.

Thanks for your thoughtful comments. Sandy

Many thanks for taking the time and responding.

I suspect we are reaching a point where we will need to agree to disagree on what the original intent of the founders was regarding the meaning of the natural born citizen requirement in the Constitution. I happen to believe that two primary sources provide conclusive evidence of the Founder’s and Constitutional Framer’s original intent.

The first is the meaning based on centuries of natural law study and scholarly interpretation, exhibited most prominently in the late 18th century in a treatise by Emmerich de Vattel titled “The Law of Nations or the Principles of Natural Law”. In Book 1, Chapter 19, Paragraphs 211-219. In those paragraphs a natural born citizen (NBC) is defined as born in the country to citizen parents.

While the definition expressed by Vattel required both soil and blood components earlier historical definitions required only a blood component; the child took the citizenship of their parents, specifically the father.

Over the years the U.S. Supreme Court has ruled in a number of cases that a NBC is a person born of the soil to citizen parents.

The second primary source is the letter written in the summer of 1787 by John Jay to George Washington, the chair of the Constitutional Convention suggesting:

“Permit me to hint, whether ti would be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American army shall not be given to nor devolve on, any but a natural born Citizen.”

Jay,s suggestion was adopted by Committee of Eleven and adopted without debate at the Convention.

I am sure you realize that since the NBC term is not addressed anywhere in the 14th Amendment, the most it can do is naturalize a person.

I suspect you may be aware of the fact that there have been a number of efforts by both Republican and Democrat legislators since 2004 to amend by Constitution’s Article 2, Section 1 Clause 5, NBC requirement. The two most suggested changes have been to shorten the time requirement and substitute the word “citizen” for NBC. Strangely, none of the attempts have gone anywhere.

I will continue to believe that neither Cruz or Rubio are constitutionally eligible to hold the office of president or vice-president since they do not meet the NBC requirement. Rubio is a citizen, no doubt, just not a NBC. Cruz many not even be a citizen.

The Constitution, itself, proves that the original intent of the framers was two different standards. To hold congressional office a person must be a “citizen” To be president or vice-president a person must be a “natural born citizen.
