THIS is Exactly WHY we DARE Not Have an Article V/COS for our Constitution!

Breitbart is reporting that there are not one, not two but now three efforts to collect signatures or other political support for an independent California (Sandy’s position on Calexit:  “Don’t let the door hit you on the way out!”) but this third one reveals a compelling reason why conservatives must avoid like poison any effort to convene a new Constitutional Convention. For this group wants to use the Article V method of amending Our Constitution to make the entire nation like California.

Here’s a salient paragraph or two from Breitbart:

“Steps to secession need to be in the Constitution,” initiative author Clare Hedin told City News Service. “No one today would even enter an airplane without an exit strategy being in place, let alone a lifelong agreement defining power structures.”

“…We believe the U.S. political system has had its day and has proved its limitations. It’s time for something new, something more intelligent and with a broader vision of the global community in which we now live and have a responsibility to contribute to positively.”

UGH!  Broader vision of the global community?  Let me go lay down for a few minutes!  🙂  I think that call to foreign missions in retirement would become compelling if this group succeeds in changing the Constitution.  (Although I do agree, a plan of secession should be in the Constitution or by positive law.)

Don’t believe me – try operative clause 21 from their submission to the California Attorney General:

Given that California’s participation in an article five constitutional
convention is an excellent opportunity to advance specific issues
dear to the hearts of many Californians, including, but not limited
to:
1.  Protecting citizens from discrimination, harm or unfair treatment,
from individuals or groups.
2.  Our state government unwaveringly protecting civilians rights to
freedom of expression and assembly as well as the equality of
opportunity for all Californians.
3.  Limiting corporate personhood for purposes of campaign finance
and political speech;
4.  Requiring women, LGBTQ and all people – regardless of ethnicity,
race, national origin, gender – to receive equal pay for equal work;
5.  Requiring the federal government to allocate funding to the states
according to the amount each respective state paid in federal taxes;
6.  Enabling CA to negotiate binding agreements with other nations,
subnational states, and nongovernmental organizations to limit
greenhouse gas emissions and other environmentally threatening
business practices;
7.  Enabling CA to negotiate binding agreements with concerned
and responding governments, and other partners, dedicated to
mitigating the impacts of worldwide refugees, loss of lifestyles and
land, due to impacts of Climate Change.
8.  Should it be deemed necessary by the majority CA population,
in order to defend California’s progressive values, civic values and
environmental concerns, we must create a clear and reasonable
path for individual States to become independent, so that CA can
secede, if they so choose;
Now people can disagree on some of those issues (I know and respect a tea party patriot who thinks Citizens United is a terrible decision  and generally devolution to local officials is a good thing) but the tone of this effort is a progressive/globalist New American Constitution.  And the threat is clear:  Exactly what I warned – The con-con effort can lead to secession, either the progressives or the conservatives will try to get out of the New United States.  Here is the earlier post right here at the blog:

So let’s go to 2016 and we have a new constitutional convention of states.  They would be elected by state legislatures or by direct elections.  Millions of dollars of money would be spent to procure delegates from the states.  Is there any doubt what sort of delegates would be elected in Massachusetts or NY or California?

That body could say:  When the constitution (I am spelling this hypothetical constitution with a small “c”) is ratified by ten states, it is binding on those states.  Or they could say, more likely, the ratification of the constitution binds those states that ratify it.  They could authorize conventions to ratify it or they could allow popular vote.

Suppose not all the states ratify the new constitution?  If liberals and globalists dominate the convention (think on this:  The GOP wants to pass trade power to the President to give multi-national corporations rights above US law – in the Trans-Pacific Partnership.  And many Democrats agree with world government to a greater extent than it is now.  We could be sold out again – and this is the Constitution we are talking about!) they could easily enact a constitution that restricts gun rights, legitimatizes abortion, places the US under the authority of the International Criminal Court and other similar groups, give the President more powers over say immigration, bans or restricts homeschooling under “children’s rights” provisions, formally bans secession, limits free speech – the Universal Declaration of Human Rights has that odious provision in it at Article 29:

(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.

And this is the 1948 UN!  The new constitution could even ban global warming “denial” and even authorize its criminalization, and enshrine political correctness into the new constitution.  That’s just a little part of it.

Suppose some states say no?  Then what?  It is either secession or civil war or both.  After all the Lincoln precedent will be used to cow some states into joining up.  Maybe the states that are left are too small or not joined together to survive on their own.  The Constitutional Republic started in 1787 will be permanently dead.

If there is an Article V Con-Con, the nation we love and its constitutional freedoms will be in peril.  Thankfully, this group of progressives has shown us what can happen.  Our representatives in this Commonwealth need to say NO to even the most harmless-sounding con-con call for a balanced budget or term limits amendment.  NO is the answer.

    Sandy — couldn’t agree more with you on the dangers and unintended consequences of the Convention of States. The most patriotic thing we can do this year is to stop the Article 5 COS in Virginia. We have witnessed assaults on the First Amendment in recent weeks played out in living color all across the country. The second amendment is constantly under attack. Just say NO to the COS.

        The most patriotic action readers can take to save our nation is to become an active leader in the Convention of States movement right away. Any imaginary dangers regarding a Convention for proposing Amendments already exist in Congress, as they can do all that now. Publius Huldah is simply another semi-constitutionalist supporting the progressive transformation of our nation.

    I have read Article 5 over & over, there is no mention of a convention called for specific purposes. It simply opens the entire Constitution to amendment. I can imagine the glee of todays Democrats if they had an opportunity to put their stamp on this sacred document. I don’t even trust the Republicans to do what they say they will. In today’s world, sadly, we have no Washingtons, Jeffersons or Franklins. I do not trust any politician today to give them free rein with our Constitution. If nothing else could convince people that this convention is dangerous and could spell disaster for this country just think, why would California agree to this convention? Do not allow this to happen!

      Mr. Tillett- Your assumption that Republicans oppose the Con Con and the Democrats support it with Glee is INCORRECT.

      Trevor Loudon exposes in his brilliantly researched book “The Enemies Within” who the the Card Carrying Communists are in the US Senate and House of Representatives. Many are Democrats. But let me assure you in Virginia, the Democrats don’t support the Con Con – it’s the Republicans who are the problem.

      In Virginia the DEMOCRATS have opposed the Con Con when it has come up for a vote in the General Assembly. It has actually passed and been narrowly defeated by one vote in recent years. Thanks to the REPUBLICAN SUPPORT FOR IT. Do your homework. IT IS THE MIDDLE RESOLUTION PAC BACKED REPUBLICANS who have voted for it every single time in Virginia’s state Assembly.

      The Virginia Republicans have aligned with the George Soros Communists. It’s the Virginia Democrats in the state senate and house of delegates who have opposed an Article V Convention of States.

      Many of us are leaving the Republican Party of Virginia by the thousands. We are sick and tired of Pacs led by Middle Resolution and Dominion Energy paying off the politicians in Richmond.

      Stop voting Republican at the ballot box and start voting ISSUES… Start with your Republican delegate. If they have voted for the Con Con in the past tell them they don’t have your vote in November unless they change their position.

      My Republican Delegate isn’t getting my vote in November. I plan to leave it BLANK.

        Vote third party in safe Republican Districts or leave it blank ( UNDERVOTE)

        YOUR ballot will not be thrown out if you don’t vote for a BAD REPUBLICAN Delegate who supports the Con Con in November. Political consultants will assess the “UNDERVOTES” and get the message.

          Delegate Buddy Fowler- R- Hanover and Caroline County supports the Con Con every single year.

          Fowler’s Democratic opponent in the last two election cycles Mrs. Toni Radler said in a debate it would be insane to open the Constitution to a Convention. She opposed the Con Con.

          Yet the gun toting Bubbas from Caroline County and Beaverdam who hunt Dogs on Sunday Vote for Bubba Buddy because they are uninformed voters who go to the polls and Vote (R) about this vital issue-

          If you support the 2nd Amendment and your right to keep and BEAR ARMS- you better figure out if your elected officials with R next to their names on the ballot are supporting the Con Con which is going to REMOVE your gun rights.

          You can believe if you open up the Constitution with this bunch of clowns running this country in the Senate and the House- you won’t have your Guns when they are finished rewriting the Constitution.
          Hillary ran for president on Gun Control and Won the popular vote…

            Delegate Buddy Fowler supports a Convention for proposing Amendments every single year.

            Fowler’s Democrat opponent doesn’t know the difference between a Constitutional Convention and a Convention for proposing Amendments.

            The smart gun owners of Caroline County vote for Fowler because they are informed voters who go to the polls to make a real difference.

            If you support Amendment II, you better figure out if your candidates support a Convention for proposing Amendments, which is going to strengthen your gun rights.

            You can believe if you open the Constitution with farsighted representatives in office that you will have access to more guns when they are finished proposing limits on the federal government.

            Sanders ran for president on free stuff for everyone, and almost won the Democrat nomination. Do you want to risk that?

          Your notion of voting third party does nothing but get the other guy elected.

          Your ballot will be thrown out if you don’t vote for a GOOD Republican Delegate who supports a Convention for proposing Amendments.

          Political consultants will assess the “OVERVOTES” and get the message.

          If you did your homework and read the Constitution, you would see that Article V has nothing to do with either Congress or the States “tampering” with the Constitution. Such “tampering” is only done through ratification by the states. Unfortunately, not trusting any politician gets you nowhere.

            Wow, good try. I have read the Constitution, several times, along with much history & research on Article 5. I find much disagreement & many legal opinions on the process. Nothing I read makes me comfortable enough to give todays politicians State or Federal free rein with the Constitution. If you haven’t already, read the book “The 5000 Year Leap” & you may understand the geniuses behind the Constitution. There exists not one person today who compares to those men. I will not respond to you with insults similar to yours, but I will agree to disagree. However, nothing I read makes me comfortable continuing to give today’s politicians, State or federal, free rein with the Constitution.

            I have already read the book “5000-Year leap. I understand the geniuses behind the Constitution. There exist few men today who compare to those men. I will neither respond to your insults, nor agree to disagree. I will also point to the recent “Obama Care” repeal vote in the Senate as one more reason not to trust federal politicians. That’s another reason why a Convention of States is the right constitutional solution at the right time.

        Unfortunately, the only supporters of a Convention for proposing Amendments are Republicans. There aren’t any Democrats who would like to see a reduction in Federal power.

        Middle Resolution is an excellent organization with a strategic understanding of the crisis we face. Do your homework and understand that a Convention for proposing Amendments is the key to getting back what we’ve lost.

        While I don’t support the Republican Party of Virginia for some of the same reasons you mention, I do support those with the strength of character to stand for what is right. This is about ISSUES – one in particular.

        Start with your Republican delegate. If they have voted for a Convention for proposing Amendments, tell them they have your vote in November.

        My Republican delegate is getting my vote in November. I plan to fill in the blank by his name.

      I have read Article V over and over, and there is no mention of a Constitutional Convention. It simply provides a forum for State commissioners to propose Amendments, a power Congress has at all times anyway. Why do you accept the authority of Congress, but not the States? I can imagine the glee of Democrats and most Republicans in Congress when they see the opposition of so-called republicans to a real solution. I do not trust any politician today to give them free rein with our Constitution. That’s why an Article V Convention is such a beautiful thing. Make this happen!

    In Virginia, the Middle Resolution Pac has spent a small fortune buying Republican votes for a Con Con and electing politicians to vote for it. Just ask Bill Stanley and Jim LeMunyon and Ryan McDougle and Chris Peace how much money they have accepted from MR to vote for an Article 5 Convention of States.

    And why would any Republican of sound mind who loves our nation and believes in the 2nd Amendment continue to donate to that PAC and support their candidates?

      The VPAP report for Robert Bailie Founder of the Middle Resolution Pac whose primary goal is to elect politicians to vote for the Convention of States in Virginia exposes many who took PAC Money and who then voted for the Con Con in Virginia. VA Right should write that article correlating dollars received and sponsorship of bills as well as house and senate votes. Interestingly, LeMunyon, Bill Stanley, and Ryan McDougle top that list. That would be a great read before November. For the Voters. To Be Better Informed. Ethics and all.

They understand the purpose of a Convention for proposing Amendments and that it is not a Constitutional Convention. It’s good to see the leading supporters on the list.         Pray tell, how you “defend” the Constitution when you don’t support all of Article V. Also, how far is that getting you? Have you had any impact on US policy? Only an organized movement like Convention of States Project has the legs to get the ball over the finish line.

        Sadly, like so many others opposed to the Constitution, you don’t understand the difference between a Constitutional Convention and Convention for proposing Amendments. Any American who does not support the entire Constitution is NO PATRIOT of this great nation.

    I agree with you that we don’t need a new Constitutional Convention. However, we are in dire need of a Convention for proposing Amendments. Since the only difference between Congress proposing Amendments and the States doing so is that Congress is in permanent Convention, while the States would only convene for a limited time, this is a much safer bet for the future of our Republic. Without it, the entire nation will become like California.

    We agree on at least one salient point – the need for a secession clause in the Constitution. How do you propose we proceed with that Amendment? Should it be proposed by Congress or the States? The answer is obvious: Congress will never cede such power to the States, so they must make it happen themselves. Hence, part deux of Article V.

    California is but one of fifty States in the Union. And since as of last September Republicans control 30 state legislative chambers, while Democrats control only 11, there is a unique opportunity to really make a difference today. The tone of our current progressive/globalist federal government is always centralization of more power. And the threat is clear: exactly what I warned – not using the entire document given to us by the Founding Fathers will lead to a socialist utopia.

    So, let’s go to 2017 and we have a significant group of constitutionalists – the Convention of States Project, leading the charge to hold a Convention for proposing Amendments. It’s a tough fight bidding against the progressives/globalists to purchase the needed number of State votes. But, since that’s the way the real world turns, it must be done. When Amendments to the original Constitution they support are ratified by 38 states, we will be in a better place.

    As for any other imaginary outcome from an imaginary Constitutional Convention, that’s all just a bunch of hokum. However, back to the real world, that can and is happening today in our federal government. Just take a look at the Constitution Annotated and you will see the hundreds of Supreme Court decisions that have amended the original Constitution.

    Suppose not all or any of the states agree with a Supreme Court decision? Well, too bad. It’s now the perpetual law of the land. If liberals and globalists dominate the federal government (oh wait, they already do!), we will continue to march toward our socialist utopia. We are being sold out by both elected and unelected officials.

    And using your logic, Congress could easily enact a new Constitution that restricts gun rights, legitimizes abortions, places the US under the authority of the International Criminal Court, gives the President more power over immigration, bans or restricts homeschooling, bans secession, limits free speech, and forces you to buy something you don’t want. Oh wait again, they’ve already done all that!

    The “New Constitution” could even define and ban deniers or haters of any kind, and enshrine political correctness. That’s just a little of what we’re already getting. Suppose some states say, “no”? Then what? They get their federal funds withheld to start. The Lincoln precedent will then be used to force such states into submission. The Constitutional Republic started in 1787 is already dead.

    If there is an Article V Convention for proposing Amendments, the nation we loved and its constitutional freedoms will once again have a chance to flourish. Thankfully, progressives/gobalists have shown us what can happen. Our representatives in this Commonwealth need to shout, “YES!” to a Convention for proposing Amendments. YES is the answer.

    A fascinating debate. Thanks to all for a vigorous and (mostly) civil debate. I am still skeptical of Constitutional conventions. I wish Mr. Dietrich was right but I fear too many states (CA, NY, MA for example) would just appoint a slate of liberals and many of the more conservative states would elect “distinguished” or “veteran” legislators and those would not effectively fight the libs. Especially with the mainstream media cheering for the libs. Nope, let’s leave the Constitution alone.
