Va. Lt. Governor Bolling Spot On with Tie Breaker Assessment

Virginia Lt. Governor Bill Bolling has done an analysis of the Constitutional Authority of the office of Lt. Governor as presiding officer of the Virginia Senate in the event of a tie. And I believe he is spot on with his read that the Constitution gives him the authority to vote in the event of a tie on all matters not specifically enumerated by the Virginia Constitution.

Lt. Governor Bolling correctly asserts that there are specific instances on which the Constitution excludes his vote as tie-breaker. The one thing that these exceptions all have in common are that they are very major circumstances, and all call for passage by a majority of those elected to the Senate. And since Bolling was not elected to serve as a Senator, any tie on financial Matters, extending the session or Supreme Court appointments must all be done by the members, i.e. the Senators.

But the obvious tone of the Constitution of Virginia in regards to Senate votes makes it obvious that the framers of the Virginia Constitution intended the body to deliberate on the big things, but not get bogged down in the small things. On matters of lesser significance, and to speed things along, the President of the Senate is allowed to break ties.

The only portion that comes close to addressing Committee Assignments, which is the heart of the matter at hand, says:

The House of Delegates shall choose its own Speaker; and, in the absence of the Lieutenant Governor, or when he shall exercise the office of Governor, the Senate shall choose from its own body a president pro tempore. Each house shall select its officers and settle its rules of procedure.

Each House shall select it’s officers and settle it’s rules of procedure.” is an important line. It does not say “the courts will decide in the event of a tie”nor does it provide for any “power sharing” that the Democrats now demand.

Somehow, one must believe that George Mason would have shuddered at the thought of intentionally deadlocking every committee with a 50-50 split. Nothing would get done. And that is just the opposite of the reason for writing the Constitution in the first place – to get things done.

The Democrats are pointing to the last time there was a tie and the Senate decided to share power between the parties. But this was not by the Democrats choice. One of their own members threatened to organize with the Republicans if the Democrats refused to share power. (That Senator later became a Republican.)

But there is no such mandate either in the Constitution or in the rules. Bolling can’s vote on the things the Constitution says he can’s vote on (in the event of a tie) and he is allowed and mandated by the Constitution to vote on all ties outside of these limits.

Senator Donald McEachin is the one leading the charge and demanding all the Senators get a trophy. That everybody play nice. But the Democrats have neither played nice nor by the rules in the Virginia Senate of late. And there are no Republicans that believe the rule breaking Democrats are worthy of any such power sharing arrangement, as they have abused their power in the past.

The courts have no role in the makeup of the Senate and as a Virginian, any attempt to rewrite the Virginia Constitution from the bench is offensive. And judge with an ounce of Constitutional Integrity will send Donald and his bunch of sore losers packing. And hopefully they will not pack a bag and shame Virginia as the Democrats in Wisconsin did.

But that would shock no one. People like Donald McEachin are more interested in power than honor. Which is a stain on the very seats they were elected to represent.

Good call Mr. Bolling. You will do Virginia proud! Stand your ground.
