RICHMOND (June 7, 2010) — Virginia has responded to the federal government’s attempt to dismiss the state’s lawsuit against the new federal health care law, Virginia Attorney General Ken Cuccinelli announced today.
In its motion to the court to dismiss Virginia’s lawsuit, the federal government argued that Virginia lacks the standing to bring a suit, that the suit is premature, and that the federal government has the power under the U.S. Constitution’s Commerce Clause to mandate that citizens must be covered by health insurance or pay a civil penalty. The government also made alternative arguments based upon its taxing power and the Necessary and Proper Clause.
Claire Guthrie Gastanaga , who earned her stripes as a lieutenant in Attorney General Mary Sue Terry ‘s office, today castigated legislators for supporting the Virginia Health Care Freedom Act which defends constitutional liberties and principles of federalism. The Act states that no individual, with several specific exceptions, can be required to purchase health insurance coverage and was passed with broad bipartisan support, in sharp contrast to the narrow straight line left of center partisan vote that enacted the federal health care bill.

Douglas Smith of the Virginia Interfaith Center for Public Policy recently published a misguided attack on the effort by Virginia legislators at the 2010 session to halt the expansion of congressional power. Smith likens that effort to Virginia’s Massive Resistance experience. Such a comparison and his understanding of the concept of federalism are way off base.
Congress is attempting to make Virginia and other states mere administrative agents for dubious public policies that the Congress either lack the money to enforce or the authority to enact. Congress has seen states pay for the programs or fail to challenge their legitimacy because of the financial and legal difficulty of doing so.
