What Is The Big Deal With Delegate Phil Hamilton?

Ok, I know that Delegate Phil Hamilton has said he did something that, in retrospect, he should not have done. Everyone seems to have their knickers in a bind. Special Session Update by Sandy Sanders

The special session called by Governor Kaine after much urging from Senator Cuccinelli (and this blog!) opened today at 10 am with a hearing of the Senate Court of Justice Committee to hear various experts in various fields.

The only witness I could stay to hear was the Lynchburg Commonwealth’s Attorney [Michael R. Doucette, who was speaking as the Secretary-Treasurer of the Commonwealth Attorney’s Association] who succinctly stated the issues arising from the Melendez-Diaz decision. His report was stark and disturbing. There has indeed been an impact on public safety.

Deeds Will Work To Allow Pelosi and Obama To Write Virginia Laws

Democratic Candidate Creigh Deeds is at it again. He is unable to find any issues on which to trump Republican candidate Bob McDonnell, so he is going back to the failed $125 million unemployment offer from Nancy Pelosi and Barack Obama.

What Deeds does not want you to know is that this $125 million offer comes on the condition that Pelosi and Obama get to rewrite Virginia unemployment laws. That’s right. These Socialists will get to write Virginia’s laws.

And Not A Pot To Pi$$ In

A few folks have noticed a lack of posts the last couple of days. No, I have not become disillusioned, tired of politics, and I am not sick. Thanks for the emails. I actually took a couple of days off to attend a family reunion in Wheeling, West Virginia, my Dad’s hometown. Honestly, I had no intention of neglecting this blog. I took my laptop and was ready to blog about the numerous events and happenings in Virginia and Nationally while I was away. But a funny thing happened. I was way too busy with my family to have any time to sleep, let alone blog. More on that later.

Drunk Drivers Being Let Go. Where Is M.A.D.D.???

The important ruling in the Melendez-Diaz case which has been a much discussed topic on this blog and others, as well as other news sources has seen those charged with driving under the influence have their cases dismissed. Governor Kaine has come down in favorMADDLOGO of, well, we are not sure what he is in favor of. He wants to do something administratively. However, the consensus among most is that this is a problem that can only be fixed by the legislature.

In a letter published here yesterday, six prosecutors from around the state lay out a pretty compelling argument for a special session, and the sooner the better.

Kaine's Failure To Call Special Session Results In 5 DUI Dismissals – STOP THIS NOW!!

Minutes after the US Supreme Court ruled in the Melendez-Diaz case, frequent guest blogger, Sandy Sanders, Esq. sent me his expert opinion on the devastating impact on the case. His fear was that if we did not do something to fix Virginia law, drunk drivers and drug dealers would have their cases dismissed. Virginia law as it now exists has been ruled unconstitutional. Is Democrat Steve Shannon Really That Clueless?

Steve Shannon hired a new campaign manager, Mike Henry, to try to make him appear to be a viable candidate. Mike needs to go back to the drawing board. Perhaps he is still reeling after managing Terry McAuliffe’s disaster of a campaign, spending money faster than President Obama and Nancy Pelosi combined with the same dismal results. Henry comes with a good history of results, managing Tim “The Absentee Governor” Kaine’s campaign as well as Mark Warner’s successful campaign for US Senate. Unfortunately for Henry and Shannon, George Bush is out of office and Obama is not doing so hot. For the first time, Henry will actually be forces to run a campaign against the actual opponent, rather than against an unpopular Bush.

GOVERNOR KAINE MUST CALL A SPECIAL SESSION TO CHANGE THE LAB REPORT LAW OR VIOLENT CRIMINALS AND DRUG DEALERS MAY GO FREE!

I wrote in a previous blog entry here at Virginia Right that McDonnell and Cuccinelli need to call for a special session of the Virginia General Assembly to amend the law on lab reports to comply with the Supreme Court’s decision in Melendez-Diaz.

I am pleased that Sen. Cuccinelli has in deed called for the special session. See the Times-Dispatch, B-3, Saturday July 11, 2009. But the governor is dragging his feet on this issue:

“My public safety team,…are analyzing the ruling to determine what it might mean with respect to staffing and our forensic lab and the availability of more people to testify…”

Supreme Court Ruling May Legalize Small Amounts Of Drugs

The Supreme Court made a ruling last month that has prosecutors everywhere trying to figure out what to do. In the case of Melendez-Diaz v. Massachusetts, SCOTUS ruled that that the accused has the right to face their accuser. In this case, the Lab Technicians. Guest Blog – Supreme Court Ruling Makes Virginia Lab Evidence Law Invalid

The Supreme Court of the United States on Thursday effectively struck down the Commonwealth of Virginia’s criminal lab report statute as violative of the Confrontation Clause of the Sixth Amendment. The case not from Virginia, Melendez-Diaz v. Massachusetts, held that lab reports cannot be admitted against a defendant but rather the actual lab examiner has to be present to testify. Laboratory reports usually deal with drugs but can also be used to introduce DNA testing as well as other forensic evidence. The spectre of overworked lab analysts shuttled throughout the state and trial delay are unacceptable. Lab reports arise in both the district courts and circuit courts.
