Circuit Court Judge Jeffrey Parker (Fauquier) Should NOT be Reappointed to the Bench

Virginia Right! joins a chorus of others in urging the Virginia Legislature to deny reappointment of Circuit Court Judge Jeffrey Parker to the bench in Fauquier or anywhere else.

Judge Parker has been such a poor judge that some citizens are even calling for his impeachment.

In accordance with Virginia law, the Executive Secretary of the Virginia Supreme Court Dec. 1 submitted evaluation reports for 27 judges eligible for reappointment. Among the circuit court judges to be officially evaluated for reappointment, Judge Parker finished dead last. All told, 155 attorneys and jurors submitted evaluations of Judge Parker. Of those, only 56% found that he displays knowledge of the law every time, only 58% found that he is faithful to the law every time, only 54% found that he allows lawyers appropriate latitude in presenting their case every time, and only 58% found that he exhibits fairness to all parties every time. Only 55.6% rated Judge Parker’s performance as “excellent.”

During his stormy 16-year term, Parker has seen many of his decision overturned. Widespread anger over the judge’s erratic behavior led Virginians from all walks of life to gather in Richmond Dec. 2 to air their complaints before the Courts of Justice Committee’s Judicial Review. Citing Parker’s controversial rulings in cases ranging from domestic abuse to land-use disputes, outraged Virginians demanded that Parker not be reappointed.

And The Fauquier Free Citizen reported:

On December 2nd, citizens were afforded the chance to weight in, and many Virginians expressed outrage over the fitness of one Fauquier County judge to continue to sit on the bench. Their circumstances and complaints covered a broad range of cases, but one theme was consistent; Judge Jeffrey Parker, Chief Judge of the 20th Judicial Circuit Court should not be reappointed.

Some cited cases where Judge Parker had a duty to recuse himself but did not, while others stressed the amount of money and hardship caused by having to appeal his rulings which in many cases have been over turned by the Virginia Supreme Court. In fact it is rumored that Judge Parker has had more rulings overturned than any other judge in the Commonwealth, which he has indicated does not bother him in the least.

In one case, Judge Parker over turned a jury verdict for no apparent reason. Fortunately the plaintiff had the resources to appeal to the Virginia Supreme Court, who ultimately ruled Judge Parker had no authority or basis to overrule the jury.

During the current evaluation period, 155 attorneys and jurors submitted reviews of Judge Parker.

Overall only 55.6 percent rated Judge Parker’s performance as “excellent.” So wouldn’t it make sense that a judge who is ranked last among his peers not be reappointed? It would except for the fact that the judicial review process is terribly flawed.

Although the Courts of Justice Committee has decided not to reappoint 15 judges in the past three years, the fact that Judge Burke McCahill, also of the 20th Judicial Circuit, is retiring on January 1st may have some bearing on the decision to reappoint Judge Parker. Lawmakers may not want to have two vacancies on the same court at the same time.

It’s time to put pressure on our elected officials and let them know that it is unacceptable to reappoint the most overturned judge in the Commonwealth of Virginia.

Remember Joe the Plumber from the 2008 election? Parker has even reached his radar on his site Joe for America. He published:

In Part 1 of this series I covered how Fauquier bureaucrats have bent the rule of law to their own corrupt ends to destroy animal owners including local farmers.   In Fauquier, politicians are in bed with Judges to subvert the rule of law.   The most notorious of these is Judge Jeffrey W. Parker, known for his disdain of women and his crazy pie-in-the-sky rulings. Judge Parker enjoys ruling against woman and handing down stiff sentences. That’s not all. Judge Parker is known for taking children away from their parents, just because he can. In one case, he took two children away from a Colorado mother and then sealed the court records so the mother could not appeal his rulings. Children of whom, neither parent lives in Fauquier County, Virginia. As such Judge Parker had no authority to hear this case.

After the Harrington case in which the Court of Appeals slapped Judge Parker’s hand you would think that he would learn his lesson. but he hasn’t.   He repeated his same illegal actions in Irina Barrett’s lawsuit by even hearing the case.   To recap Part 1, of this series, animal rights extremist Hilleary Bogley illegally seized several dogs from champion dog breeder Irina Barrett who sued her in federal court for theft and defamation.

Hilleary Bogley moves and shakes with the wealthy eco-freaks of the Piedmont Environmental Council who targeted Martha Boneta. She was able to exercise her power and get the lawsuit moved to the Virginia state court system and assigned to the court of notorious Judge Jeffrey Parker.   Shocking no one, Judge Parker appointed Bogley to her powers as a humane investigator. Under the law, Hilleary Bogley has the power to operate as a private law enforcement officer in Fauquier and Culpepper Counties with no accountability. She has no authority to operate anywhere else but she uses her powers to steal animals from wide areas of Virginia and West Virginia regularly.

Judge Parker who appointed Bogley to her position abusing power over others is hearing the lawsuit against her over her abuse of power.   How is that not an conflict of interest? Why hasn’t Judge Parker recused himself from the Irina Barrett lawsuit? The abuse of power in Fauquier County, Virginia is breathtaking. In October of 2015, Judge Parker issued a ruling giving Hilleary Bogley immunity under the law and dismissing Irina Barrett’s lawsuit against her. After fighting to expose Hilleary Bogley in federal and state court for two years, Irina Barrett is broke.   Broke by design.   As just an average every day American dog breeder struggling to get by, she went up against the daughter of a multi-millionaire lawyer.   It wasn’t a fair fight.

Walking out of court triumphant animal rights extremist Hilleary Bogley conducted an illegal raid of a local Cavalier King Charles Spaniel breeder on the same day.   This greedy animal rights extremist has only been encouraged by the backing of corrupt Judge Parker.   The noxious sewer stink coming out of Fauquier is infecting the entire state.

And let’s not overlook what this horrendous judge recently did to Martha Bonetta, the Virginia treasure and champion of property rights:

In a ruling that provides compelling evidence that Virginia is in dire need of judicial reform, 20th Circuit Court Judge Jeffrey W. Parker (Fauquier County) Dec. 21 dismissed charges brought by farmer Martha Boneta against the Piedmont Environmental Council (PEC) while allowing Boneta’s case against her neighbors, Phillip and Patricia Thomas, to proceed.

In a case that has attracted national attention, Boneta, owner of a 64-acre farm in Paris, Va., and her Piedmont Agriculture Academy, LLC (PAA), charged the PEC with unlawful and unreasonable conduct in connection with the enforcement of a conservation easement on PAA’s farm, including instigating and coordinating litigation against PAA with Mr. Thomas to purportedly enforce the conservation easement even though Thomas is not a holder of the easement and cannot legally have enforcement rights, encouraging Fauquier County officials to issue unwarranted zoning citations against PAA; and encouraging government officials to audit PAA.

showing collusion between the PEC and the Thomases, Parker dropped all charges against the Warrenton, Va.-based land trust. In fact, the allegations against the two parties were the same. How impartial was Judge Parker? Months before the PEC case was even heard, Judge Parker proclaimed from the bench that he “didn’t believe the PEC was guilty of wrongdoing.” This bizarre statement foreshadowed how Parker would rule when the case and the evidence were finally before him nearly a year later. For her part, Boneta plans to appeal the ruling and has separate suit pending against the PEC.

Virginia deserves better. Parker himself has said that he is unlikely to finish the next term, if appointed, due to health issues.

Parker should be sitting at home, not on a Judicial bench.
