Sign the Petition for a Moratorium on New Residential Construction in Hanover County, VA

In recent years, there has been a great deal of growth in the Atlee Station Road corridor.  While this area is designated as suburban service area per the comprehensive plan, nearly half of all new residential construction in the entire county was located along this 4 mile stretch of road.  There are well over 1000 additional units planned for this area with no plan to address the traffic congestion, safety, or schools.

Development is important, but it should be done with great care to maintain and improve upon what people love about Hanover.


We, the undersigned citizens of Hanover County petition the Board of Supervisors of Hanover County, Virginia to enact the following:

A moratorium to halt the rezoning of any parcel of property not currently designated as residential to residential, and the issuance of new building permits to any entity desiring to construct new residential structures.  This would not preclude a homeowner or landlord from obtaining a permit for property improvements, nor should it prevent a landowner from subdividing their property to deed to a family member for construction of a primary residence.

This moratorium would take effect immediately and expire either in 12 months, or at which time both the Comprehensive Plan review of 2017 is complete, and the county has developed a long term strategic plan to address increased traffic and school populations in the Suburban Service Area including cost and funding plans.

This moratorium is necessary due to the current level of growth being experienced in certain parts of the Suburban Service Area within county.  The specific references below are in regards to the Atlee Station Road corridor, but are representative of what could happen anywhere if this is left unchecked.

·        Currently there is nothing in the Hanover County Capital Program (2017-2021) for widening the 4 mile long, two lane road.  Any potential widening relies on speculative funds.  Widening much of the road would also require the loss of land and or displacement of several residents who live on ASR.

·        Of the 360 new home sales in Hanover County in 2016, 175 were in the ASR corridor, with 154 units directly contributing to traffic on ASR.

·        The schools directly affected by the development are currently nearing capacity, yet there has been no significant public discussion on redistricting, or construction of new schools.

·        A current proposal in front of the board places the density of the proposed subdivision at nearly twice that of the surrounding area despite the Comprehensive Plan directive that development shall ensure land uses “harmonious with surrounding uses and residential density.”

    Thank you for publishing this petition on VA Right. It goes against the “property rights” positions of staunch libertarians. Agreed. But it exposes the lack of leadership by Hanover County Board of Supervisors elected in 2011 who approved the 2013 twenty year Comprehensive Plan which opened up Hanover County to irresponsible high density housing and “multi-use zoning” with no means to pay for it.

    The explosion of residential development has led to Hanover’s needs for full time Fire and EMS to replace a volunteer force and more than 220 Sheriff’s Deputies in addition to the Town of Ashland’s police force of 25 officers. This expansion of services has driven the budget up tens of millions of dollars since the “All Republican Board of Supervisors” elected in 2011 by their developer donors began the “Chesterfielding of Hanover County.” The longer term cost of pensions, disability, vacations and healthcare of the ever growing Hanover County government bureaucracy can’t be outlined in a comment section on this blog. The cliff notes version is Hanover Taxes are going up forever with no end in sight.

    Virginia’s General Assembly is facing a billion dollar budget shortfall in 2017. McAliffe with a Republican House and Senate has been a disaster for the last four years. VDOT no longer has the funds to support Hanover roads. The All Republican board of supervisors eliminated proffers in 2012 which would have provided more than $150 million in fees at $19,500 each from the housing units they approved which the board and the county now realize they need. How do we know this?

    Hanover County Supervisors are lobbying the GA as this is being written for local taxing authority to impose more taxes on Hanover citizens without referendum. The very supervisor Wayne Hazzard who ran in 2011 on a campaign platform against Meals Taxes and support of Spending Cuts is lobbying the GA for tax increases. A Wheels Tax is coming to Hanover County vehicle owners and residential property taxes have gone up in recent assessments received in the mail.

    The 600 pound gorilla in the county boardroom is the current municipal bond debt which exceeds $161 million dollars and the Hanover’s need in the near future for more schools. Schools now cost from $50 million to over $100 million. Just ask Henrico County who built Glenn Allen High School. Hanover County is looking at hundreds of millions of dollars in additional bond debt SOON to provide schools for the tens of thousands of new housing units approved by this board.

    Libertarians oppose petitions such as this stating that a property owner has the right to do with his property what he wishes.

    However, the overdevelopment of Hanover County was partially based on removal of proffers taxes by this board. The twenty thousand dollar per home proffer tax served as “passive resistance” to irresponsible high density housing development in Hanover County.

    In 2013 zoning changes were made to the 20 year Comp Plan imposed by those same developer donors through their elected officials to the Board of Supervisors who appoint their planning commissioners. The apparent result is tax increases and budget increases and the need for new schools the citizens can’t afford. Mismanagement of a county is a legitimate reason for the citizens of a county to call “Time Out.’ Even LIbertarians should see this rationale.

    Bath County is recalling three of its supervisors from its county board. Perhaps Hanover needs a recall of Canova Peterson, Wayne Hazzard, Sean Davis who all voted to eliminate proffers in 2012 with no means of replacing that revenue.

    Excellent comment above. Informative for newcomers to Hanover County.

    Legitimate rationale for “recall” of Supervisors Hazzard and Peterson who ran as a team to repeal The Proffers in Hanover County for their developer/donor class. That was never disclosed during their campaign in 2011. Hazzard owed hundreds of thousands in proffers taxes as well as his donors and campaign volunteer from South Anna. Personally profiting from his vote crossed the ethics line.

    Bait and Switch is a reason to impeach Hanover County supervisors.

    A proposed Virginia House of Delegates bill would institute recall elections in the commonwealth for the first time. Last year at least five elected official faced citizen actions to remove them from office. Citizens have mounted petition drives to remove a Prince William County School Board chairman, three members of the Bath County Board of Supervisors and Montgomery County Circuit Court Clerk Erica Williams. Those three cases, all of which under current law must be decided by a court, prompted Del. Rich Anderson, R-Prince William , to ponder the state’s process for removing elected officials.
